Para se qualificar para este visto, o investidor precisa\u00a0fazer um investimento \u201csubstancial\u201d em uma empresa e ser cidad\u00e3o de um pa\u00eds que mant\u00e9m um Tratado de Com\u00e9rcio e Navega\u00e7\u00e3o com os Estados Unidos. Para prop\u00f3sitos do visto E-2, o empreendedor dever\u00e1 entrar nos Estados Unidos exclusivamente para desenvolver e direcionar a empresa de investimento. Isto \u00e9 estabelecido mostrando pelo menos 50% de propriedade da empresa ou posse de controle operacional. O requerente do visto E-2 pode ser o dono da empresa ou um de seus empregados. O empregado deve possuir um cargo de executivo ou supervisor, ou possuir habilidades que s\u00e3o altamente especializadas e essenciais para a opera\u00e7\u00e3o da empresa.<\/p>\n<p><strong><u>Sobre o investimento<\/u><\/strong> \u00a0<\/p>\n<p>A lei americana afirma que o investimento deve ser substancial, mas n\u00e3o especifica um valor m\u00ednimo. Portanto, as decis\u00f5es sobre os pedidos de visto E-2 dependem muito das circunst\u00e2ncias espec\u00edficas de cada caso. No entanto, para ter boas chances de aprova\u00e7\u00e3o, aconselhamos que se considere um investimento m\u00ednimo de\u00a0 US$ 100.000,00. O requerente do E-2 deve demonstrar que os fundos n\u00e3o foram obtidos, direta ou indiretamente, de atividades criminosas. A empresa precisa ser um empreendimento comercialmente ativo que gere lucro, vendendo produtos ou servi\u00e7os. Al\u00e9m disso, para ser considerado substancial, o capital de investimento deve:<\/p>\n<ul>\n<li>Ser substancial em rela\u00e7\u00e3o ao custo de compra de uma empresa j\u00e1 estabelecida, ou em rela\u00e7\u00e3o ao estabelecimento de uma nova empresa;<\/li>\n<li>Ser suficiente para assegurar o compromisso financeiro do investidor para o sucesso operacional da empresa; e<\/li>\n<li>Possuir magnitude para suportar a probabilidade de o investidor desenvolver e dirigir a empresa com sucesso. Quanto menor o custo da empresa, maior, proporcionalmente, o investimento deve ser, para ser considerado substancial.<\/li>\n<\/ul>\n<p>O investimento n\u00e3o pode ser marginal. Investimento marginal \u00e9 aquele que n\u00e3o tem a capacidade atual ou futura de gerar renda mais do que suficiente para proporcionar uma condi\u00e7\u00e3o de vida minimamente confort\u00e1vel para o investidor do tratado e sua fam\u00edlia. Dependendo dos fatos, uma nova empresa pode n\u00e3o ser considerada marginal, mesmo que n\u00e3o tenha a capacidade atual de gerar essa receita. Em tais casos, no entanto, a empresa deve ter a capacidade de gerar tal renda dentro de cinco anos a partir da data de in\u00edcio da classifica\u00e7\u00e3o de E-2 do investidor. Os regulamentos para o visto E-2 requerem que os fundos sejam \u201cirrevogavelmente comprometidos\u201d com o investimento, antes do visto ser emitido. Esta exig\u00eancia pode ser atendida ao demonstrar que seus fundos j\u00e1 se apresentam em risco. Dessa forma, o requerente \u00e9 obrigado a investir em um neg\u00f3cio nos EUA antes de iniciar o processo de solicita\u00e7\u00e3o do visto E-2, seja por meio da aquisi\u00e7\u00e3o de um neg\u00f3cio, ou do estabelecimento de um novo neg\u00f3cio, pelo menos, ao ponto de estar pronto para iniciar as opera\u00e7\u00f5es. N\u00e3o s\u00e3o permitidos investimentos passivos, como a\u00e7\u00f5es e receita de alugu\u00e9is, e nem especulativo, onde o neg\u00f3cio est\u00e1 apenas no papel. Para dar entrada no visto \u00e9 preciso que j\u00e1 tenha sido feitos investimentos na empresa e que ela esteja prestes a iniciar suas opera\u00e7\u00f5es ou j\u00e1 em atividade. \u00c9 importante ressaltar que o investidor deve demonstrar que tem a habilidade para desempenhar uma boa administra\u00e7\u00e3o de seu neg\u00f3cio. Por esta raz\u00e3o, hist\u00f3rico profissional, acad\u00eamico, treinamentos, etc. s<em>\u00e3o<\/em>\u00a0relevantes na hora de se avaliar o potencial de sucesso do neg\u00f3cio. \u00a0<\/p>\n<p><strong><u>Quanto tempo dura o processo de visto de investidor E2?<\/u><\/strong> \u00a0<\/p>\n<ul>\n<li><strong>Aplica\u00e7\u00e3o\u00a0fora dos EUA<\/strong>: Se o requerente estiver fora dos Estados Unidos, ele poder\u00e1 aplicar para o visto diretamente no Consulado. Solicita\u00e7\u00f5es de visto de investidor no Brasil podem ser realizadas nos Consulados em S\u00e3o Paulo e Rio de Janeiro. O tempo de processamento de um visto E-2 varia de acordo com o Consulado entre duas semanas e quatro meses. Ap\u00f3s a conclus\u00e3o de uma an\u00e1lise inicial, o Consulado marcar\u00e1 uma entrevista com o candidato. Se o visto E2 for aprovado, poder\u2019a levar at\u00e9 uma semana para que o visto seja emitido.<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<ul>\n<li><strong>Aplica\u00e7\u00e3o dentro dos EUA:\u00a0<\/strong>Os pedidos de visto E-2 podem ser apresentados diretamente no USCIS. Neste caso, o processo leva aproximadamente cinco meses. No entanto, o requerente tem a op\u00e7\u00e3o de pagar uma taxa de processamento premium de US$1,440 para que o pedido seja julgado dentro de quinze dias. \u00c9 importante observar que uma mudan\u00e7a de status nos EUA n\u00e3o resultar\u00e1 no <u>visto E-2<\/u>, mas apenas\u00a0 <u>status E-2<\/u>. Ao deixar os Estados Unidos, o investidor deve estar em posse de um visto E-2 para retornar ao pa\u00eds, devendo, dessa forma, passar por entrevista no Consulado Americano.<\/li>\n<\/ul>\n<p><strong><u>Dura\u00e7\u00e3o<\/u><\/strong> \u00a0<\/p>\n<p>Geralmente, o visto E-2 \u00e9 concedido por um per\u00edodo de\u00a0<strong>5 anos <\/strong>(2 anos para altera\u00e7\u00f5es e extens\u00f5es de status nos Estados Unidos). N\u00e3o h\u00e1 limites para o n\u00famero de renova\u00e7\u00f5es que um titular de visto E-2 pode obter, desde que o neg\u00f3cio esteja ativo e atenda aos requisitos do departamento de imigra\u00e7\u00e3o, inclusive gere lucros \u201cn\u00e3o marginais\u201d, ou seja, n\u00e3o gere apenas uma renda\u00a0 suficiente para garantir um sustento m\u00ednimo para o investidor e sua fam\u00edlia. O requerente deve ter a inten\u00e7\u00e3o de partir dos Estados Unidos ap\u00f3s a conclus\u00e3o das atividades comerciais. O visto E-2 n\u00e3o cria um caminho para obter a cidadania americana (ao contr\u00e1rio dos vistos americanos das categorias H-1B, L-1 e EB-5). \u00a0<\/p>\n<p><strong><u>Benef\u00edcios para a fam\u00edlia<\/u><\/strong> <strong>\u00a0<\/strong><\/p>\n<p>Al\u00e9m de autorizar o seu portador a viver legalmente nos EUA, o c\u00f4njuge de um titular de visto E-2 pode obter o mesmo tipo de visto nos EUA e at\u00e9 permiss\u00e3o para trabalhar em qualquer outra empresa americana. As crian\u00e7as solteiras com menos de 21 anos tamb\u00e9m podem receber o mesmo tipo de visto americano que os membros da fam\u00edlia, mas n\u00e3o poder\u00e3o trabalhar, embora tenham a oportunidade de se matricular na escola. N\u00e3o \u00e9 necess\u00e1rio que eles tenham a mesma nacionalidade do solicitante principal.<\/p>\n<p><strong><u>Visto E-2 para Brasileiros<\/u><\/strong>\u00a0<\/p>\n<p>O Brasil atualmente n\u00e3o faz parte do Tratado de Com\u00e9rcio, no entanto, brasileiros que t\u00eam outra nacionalidade e que desejam fazer um investimento substancial podem se qualificar para o visto E-2.
