The R-1 visa allows religious workers to legally work in the U.S. for a sponsoring religious organization for an initial period of up to three years. R-1 visa holders can travel freely within the U.S., and their spouse and unmarried children under 21 may accompany them with R-2 visas. To qualify for an R-1 visa, an individual must be authorized by a recognized employing entity to conduct religious worship and perform other duties typically performed by clergy members of that religion.
Additionally, the applicant must be a member of a religious denomination with a legitimate nonprofit organization in the U.S. The denomination and its affiliates must also be exempt from taxation or qualify for tax-exempt status.
The applicant must have been a member of the denomination for at least two years preceding the application.
While there is no requirement to maintain a residence abroad, R visa holders must intend to depart the U.S. at the end of their lawful status. If an individual has previously spent five years in this classification, they must have resided and been physically present outside the U.S. for the prior year.
