Starting the E-2 Visa: What You Actually Need vs. What You Think You Need There’s a myth about the E-2 visa, but I want to clear up right away. You do not need a business, a business plan, employees, or an office before you begin. Most people assume they need to have everything sorted out before they could take any real steps forward. But in my experience, the opposite is true. The earlier you start exploring this process, the clearer everything else tends to become. Hello there. I’m Sal Picataggio, immigration attorney and partner at Colombo & Hurd, and I work with E-2 investors all over the world from the very first time they hear about the visa all the way through approval. In this video, I’m going to walk you through what starting this process actually looks like. What you truly need to get going. I think you’ll find it’s a lot less than you expected. Now, a lot of people assume they need to have their business fully set up, their investment ready to go, or even business-related purchases already made, and every detail sorted out before they can start the visa process. So, they wait. They keep researching. They keep second-guessing. And months go by without any real progress. But here’s the good news. You don’t have to wait for any of that. For a lot of investors, starting earlier actually works better. Now, when you understand what the visa requires from the beginning, every decision you make along the way becomes a little clearer, a little more intentional. You’re not guessing. You’re building toward something. And look, if you’re feeling overwhelmed right now, that’s completely normal. Almost every investor I speak with at this stage feels some version of that. And most of the time, it comes down to one thing. Not knowing what actually matters right now. It usually sounds like one of these. I don’t know what business to choose yet. That’s okay. You don’t really need to have a business picked out right away. In fact, understanding the E-2 requirements first can actually help you narrow down what kind of business makes sense for your situation and how it fits in with the immigration requirements. I’m not sure how much I need to invest. Also okay. There’s no fixed dollar minimum for the E-2. Depends on the business, the nature of it, the costs, and that answer looks different for everyone. Now, that’s it. I do want to be up front that we will need to have a substantial amount ready to commit before we file your case. A good working benchmark is around $100,000, though it varies by business type. You don’t need to have it in motion before you start working with us, but you should be ready to commit it to the enterprise when the time comes. It means you have full flexibility to do things in the right order from the start. And we can help get those things set up according to the immigration requirements. I’m still just exploring my options. That’s exactly where most people are when they first start looking into the E-2. You’re in good company. And we can help you review those options for immigration compliance. Now, this is something I really want you to hear from me because I think it’ll take some pressure off of you. Before starting your E-2 process, you don’t need employees yet. You don’t need office space yet. You don’t need a fully functioning, running, operating business yet. You don’t even need a finished business plan yet. None of that is required to start the process. If you’ve been waiting on any of that, you may not have to. And again, I want to be clear about one thing. When it comes time to actually file the case, all of these things will need to be in place and well documented. The application requires proof of your investment, your business structure, your plan, all of it. But the key point is you don’t have to figure all of that out before we can start helping you. Getting it sorted is a big part of what we’re here to help you do. So, what does matter right now? I think it comes down to two things. The first is your treaty nationality. The E-2 is only available to citizens of countries that have an active treaty with the United States. And that is determined by your passport, not necessarily where you were born or where you currently live. If you are a citizen of a qualifying country, you’ve already got a foundational piece that the E-2 is built on. And the second is your genuine desire and the ability to invest. And by that, I mean to commit the capital to the US business and actively run this business in the United States. The E-2 is designed for people who want to come here, actively build something, and not just put money somewhere passively. Everything else, the business type, the investment amount, all the documentation, that’s something we develop as the process moves forward. Those aren’t things you need to have already figured out by yourself or right now or before you begin. It’s exactly this process is helping you to work through. And here’s what I’ve seen when investors start engaging with the E-2 process early, while they’re still in the exploration phase. Things tend to get clearer much more faster. A lot of the uncertainty that feels heavy at the start, which business, how much to invest, what’s the structure going to look like, and it all starts to resolve once you actually understand what the E-2 requirements are looking for. Decisions feel more grounded. When you understand the framework, you have a better sense of what you’re doing, why you’re doing it, and you’ll have a realistic picture of the timeline. How long documentation takes, what USCIS is looking for, and how your specific situation fits into all of it. Instead of trying to figure everything out all at once, the path forward becomes a lot more concrete. You start to understand the steps, what needs to happen first, and next, and next, and next, what can wait until later, what actually matters for your case. That alone could take a lot of the stress out of it. And one more thing I’m going to leave you with before we finish up today. A lot of people think starting the E2 process is something that happens once everything else is already in place. The instinct behind that makes sense. You want to feel prepared before you take any real significant step forward, but the process itself is actually one of the things that helps you get prepared. Understanding what the E2 requires before you start making commitments to businesses or timelines, before you’re moving money, before you signed anything, means the decisions you do make are better informed. There’s less backtracking, less uncertainty, and a much clearer path forward.
