The E-2 visa allows treaty investors to enter the United States to develop and direct a qualifying business investment. In this case, our client secured a five-year E-2 visa through the U.S. Consulate in Brussels, Belgium, to operate a business implementing financing solutions for technology companies in the United States. The E-2 visa is available to nationals of countries that maintain a qualifying treaty of commerce and navigation with the United States. To qualify, the applicant must demonstrate that the investment is substantial, that the funds are at risk in a real and operating enterprise, and that the investor will develop and direct the business. The E-2 visa is typically issued for two to five years depending on the treaty country, and is renewable indefinitely provided the business remains operational and the investor continues to meet the eligibility requirements. Qualifying investments can range from the purchase of an existing business to the formation of a new enterprise, and the visa also allows the investor to bring a spouse and dependent children to the United States
