EB-2 NIW Case Study: Approval for Civil Engineer from the Philippines Focused on Modernizing U.S. Oil and Gas Pipeline Infrastructure

Every EB-2 NIW petition has to connect a person’s work to a broader national benefit. Strengthening pipeline infrastructure is valuable on its own, but the petition needed to show that this work carried importance reaching well beyond any single company or client. The response documented how this work would reach far beyond one engineer and the handful of companies he might serve. The team gave USCIS a more specific picture of that reach, tracing how advanced tools like BIM and VDC translate into real gains in safety and efficiency on the kind of complex pipeline projects the industry depends on. Because smaller firms account for so much of the U.S. oil and gas sector, enhancing their technical capabilities was shown to move the needle across the whole industry.

The team also provided greater detail about how and where the client planned to pursue the endeavor in the United States. That plan, paired with additional supporting letters from colleagues and other professionals in his field, showed a professional with both a credible path forward and real interest in what he set out to do. Together, the evidence connected his proposed services to broader pipeline modernization efforts and showed how his 16 years of project and construction engineering experience prepared him to undertake the work.

USCIS approved the EB-2 NIW petition following the RFE response, with Premium Processing. The additional evidence gave the officer a full view of the endeavor and our client’s ability to advance it.
