EB-2 NIW Green Card Case Study: Approval for IT Specialist from Mexico

The petition laid out the client’s plan to launch and grow his consulting firm. USCIS issued an RFE asking to see the financial side of that plan in more depth, including how the business would be funded, and how it would operate and grow over time.

The response included a detailed business plan that explained the consulting firm’s services, target market, operating strategy, and multi-year growth and hiring projections. The plan also showed that the funding to launch the business was real and available. The team worked closely with the client to document those resources, including bank statements and evidence of assets owned by the client’s family.

The initial petition already contained strong supporting evidence. From the start, letters from colleagues had confirmed the client’s technical ability and leadership, and a business owner had expressed strong interest in hiring the firm, drawn by its potential to solve budget and technology problems he had faced for years. That interest reflected real demand for exactly the services the client planned to offer.

As Senior Attorney Nizar Kafrouni explained: “USCIS wants to see more than a plan on paper. They wanted proof that the client has real entrepreneurial ability and a realistic, complete plan that shows exactly how the business will get off the ground in the United States.”

USCIS approved the EB-2 NIW petition after reviewing the response to the RFE and the additional evidence submitted with it. The client subsequently completed the AOS process. He is now a permanent resident and can build his consulting firm in the United States. As the business expands, his plan is to train the staff at the companies he serves and open roles for recent technology graduates entering the field.
