O-1B Case Study: Approval for Music Producer from Spain in 17 Days

Spain

Music Producer

Colombo & Hurd secured approval of an O-1B petition for a musician and music producer from Spain who specializes in rock, folk, and American roots music. USCIS approved the petition within 17 days with Premium Processing and without a Request for Evidence (RFE).

Our client fronts a band with an established following in Spain and across Europe. He writes songs, sings lead, plays guitar, produces records, and has spent more than fifteen years building his career in music, including audio engineering and post-production for other artists. His experience across performance and production will now support two U.S. positions: leading artist development for a music production company and managing sound engineering for a hospitality group.

Colombo & Hurd  Senior Immigration Attorney Allison McVey  led the petition, which a designated U.S. agent filed on behalf of both employers. This structure allowed the petition to cover both positions rather than requiring separate O-1B petitions for each employer.

Client Profile

A Career Built on Stage, in the Studio, and Behind the Mixing Board

Our client has specialized training in sound and audiovisual post-production, along with advanced vocational training. He has been a member of Spain’s authors’ and publishers’ society since 2014, and a global music publishing company has represented his catalog since 2019. Alongside his own releases, he has worked as a freelance engineer, managing clients and delivering recording, editing, and post-production projects.

His band has released multiple studio albums and toured Spain, the United Kingdom, and the United States. Spain’s national public broadcaster nominated him for Best New Artist, and a government-produced television program featured him in two episodes. A U.S. heritage society invited him to perform at a cultural event tied to a documentary premiere, and he has recorded at a historic studio in the American South. Music magazines, national newspapers, and online outlets in Spain, Germany, and the United States have covered his work for nearly a decade.

His planned work in the United States draws on both sides of his career. For the music production company, he will write and arrange original material, shape artists’ sound and stage presentation, and coordinate bookings and tours. For the hospitality group, he will tune and maintain sound systems, supervise live sound checks, and manage audio across hotels, restaurants, bars, and event spaces.

The Challenge

Showing Extraordinary Ability Across Performance and Production

The petition had to connect a record that reached across several areas of music to the specific criteria USCIS uses to evaluate extraordinary ability in the arts. The petition presented his field as music, broad enough to cover the performer directing a band and the professional managing audio for a venue.

Because he will work for two employers, an agent filed the petition on behalf of both companies, with each one authorizing the agent to act for it. O-1B petitions in the arts also require a written advisory opinion from an appropriate peer group, which the client obtained as part of the petition process.

Strategic Approach

Matching the Evidence to Each O-1B Criterion

The petition claimed three of the six O-1B regulatory criteria, showing that the client had performed as a lead or starring participant in productions and events with distinguished reputations, that he had received national and international recognition in major publications, and that organizations, critics, and recognized figures in the field had acknowledged his achievements.

To document his leading roles in distinguished performances and events, the record paired each event with proof of its standing. Festival announcements, press coverage, concert posters, and photographs confirmed that he held a central role at events with long histories and well-known lineups. To demonstrate his published recognition, the petition organized nearly a decade of coverage by outlet and year, showing a sustained pattern across print, broadcast, and online media in three countries. As evidence that his work has been recognized in the field, it presented letters from senior industry figures alongside the contracts, nominations, and representation agreements that backed up their assessments.

The petition also included evidence of his long-standing membership in a recognized rights management organization as comparable evidence, reinforcing his professional standing in the field.

The Result

O-1B Approved with Premium Processing and Without an RFE

USCIS approved the petition on October 1, 2026, just 17 days after receiving it. The petition proceeded under Premium Processing, and USCIS issued no Request for Evidence (RFE). The O-1B status is valid for three years, through October 2029.

Once he obtains his O-1B visa through the U.S. Embassy in Madrid and is admitted to the United States in O-1B status, the client can work in both positions for the duration of his authorized period. He will lead music production and artist development for one company while overseeing sound engineering for the hospitality group’s venues.

The agent-filed petition allows him to pursue both positions under one approval, bringing his experience as a performer, producer, and sound engineer to his work in the United States.
