EB-2 NIW Case Study: Approval for Finance Executive from Chile

Chile

Finance Executive

Colombo & Hurd secured approval of an EB-2 National Interest Waiver (NIW) petition for a finance executive from Chile who specializes in financial planning and performance management for small and medium-sized businesses. USCIS approved the petition following the firm’s response to a Request for Evidence (RFE).

Small businesses employ almost half of America’s private-sector workers, making their long-term success key to the U.S. economy. Yet, about half of new businesses close within five years. Many smaller companies lack the timely financial insights that larger companies get from dedicated finance teams, making it harder to identify problems and take corrective action.

Our client has spent more than two decades in finance leadership, including roles as finance manager and managing director. He plans to help small and medium-sized businesses strengthen their financial health by using an online tool that reviews a company’s operating data, flags underperformance, and produces a customized corrective action plan, so owners can identify problems early and make better-informed decisions. Attorney Aaron Labreque led the petition.

Client Profile

A Finance Leader Who Turns Company Data into Decisions

Our client holds an MBA and a diploma in corporate finance. He has held finance leadership roles at multinational companies in financial services, corporate banking, and industrial manufacturing. Today he serves as finance manager and managing director of an industrial company, where he also sits on the board.

Throughout his career, the client has designed financial tools that improved business performance. At a multinational services group, he created a balanced scorecard and financial dashboard that helped the company exceed its gross margin target by 16% and its operating profit target by 28%. This work earned the group’s annual award for management excellence.

At the manufacturing company, the business grew by more than 260% in ten years, and he was responsible for designing the cash flow, receivables, and inventory systems to manage it. One of these tools helped reduce overdue receivables from approximately 60% to less than 5% within a year.

In the United States, he will develop and run an online platform that gives small and medium-sized businesses a regular financial health check. The platform will provide cash flow monitoring and projections, budget planning and control, and preparation for financing. His business plan projects 17 U.S. hires over five years, funded with his own capital.

The Challenge

Showing That a Tool for Individual Businesses Carries National Importance

The central challenge was demonstrating how the client’s proposed financial management platform could benefit the U.S. economy beyond the individual businesses using it. Although the platform was designed to help companies improve their financial performance, the petition needed to establish its potential broader impact on small business growth, financial stability, and access to capital.

USCIS confirmed the client’s advanced-degree eligibility and issued an RFE focused on the substantial merit and national importance of his proposed endeavor, whether he is well positioned to advance it, and whether, on balance, it would benefit the United States to waive the requirements of a job offer and labor certification. The RFE asked for a more specific description of his planned work in the United States, a business plan to show its economic effects, and more detail on his past contributions and their impact on the wider industry. These were questions the existing record could answer.

Strategic Response

Building on a Clear Endeavor with Evidence of Impact

From the initial filing, the petition centered on the client’s plan to make professional financial management tools more accessible to small and medium-sized businesses.  The record showed how that work fits with federal programs that support small business growth, including the Small Business Administration (SBA) and its Small Business Development Centers for counseling and training, SCORE mentoring for entrepreneurs, and the NIST Manufacturing Extension Partnership for business performance and competitiveness. Letters of recommendation from senior executives and financial professionals documented the client’s past achievements and the measurable results of the tools he developed.  Evidence of a formed U.S. company, a project charter, and letters of interest showed the plan was already in motion.

In response to the RFE, the legal team included a more detailed statement of the proposed endeavor and a supplementary business plan with service descriptions, five-year financial projections, and a hiring plan for 17 U.S. positions. The plan showed projected jobs and tax contributions reaching economically distressed areas. The response also showed the client’s personal funds available to launch and sustain the venture without taking on loans. New letters of interest from a potential business user and a potential investor confirmed demand in the U.S. market.

As Attorney Aaron Labreque explained: “Our strategy focused on demonstrating that the client’s proposed endeavor addressed a broader economic need in the United States. We connected his experience developing financial management solutions with a concrete plan for making those tools accessible to small businesses, supported by evidence of market demand, financial viability, and the potential for economic impact beyond his own company.”
