NIW Case Study: Documentary Film Professional from Chile Secures National Interest Waiver

Chile

Documentary Film Professional

The EB-2 National Interest Waiver (NIW) provides a pathway for foreign nationals with exceptional ability or advanced degrees to obtain permanent residency without a job offer or labor certification. To qualify, applicants must demonstrate that their proposed work has substantial merit and national importance, that they are well-positioned to advance their endeavor, and that waiving the job offer requirement would benefit the United States.

Colombo & Hurd Immigration Attorney Aaron Labreque recently secured EB-2 NIW Petition approval for a documentary film professional from Chile, who uses documentary film as a medium to raise awareness of food insecurity across the United States and to generate funding that supports efforts to address these pressing challenges. This recent approval demonstrates that NIW for creative professionals is a viable immigration pathway.

Our client uses film to raise awareness of food insecurity and help fund efforts to address it.

Our client is an experienced film and television professional from Chile with a bachelor’s degree in his field and over 18 years of progressive work experience. Throughout his career, he has worked as a camera operator for talk shows and corporate videos, produced documentaries, served as editor-in-chief for various projects, and handled complex logistics for film productions across the United States. His portfolio includes credits on major motion pictures produced by Marvel Studios, New Line Cinema, Warner Bros. His hands-on experience across filming, editing, translating content, and managing full documentary productions has directly supported his current work using film to raise awareness of food insecurity in the United States and help fund efforts to address it.

The Challenge

Demonstrating how artistic endeavors could qualify for NIW

The primary challenge in this case was demonstrating how artistic endeavors could qualify for NIW approval by showing national importance and substantial merit. Specifically, we needed to establish that the client’s proposed endeavor of conducting personal interviews, producing documentary films, and developing national media campaigns about food insecurity would serve the national interest and create an impact throughout the United States.

The key hurdles included:

  • Proving that documentary filmmaking addressing social issues constitutes work of national importance
  • Demonstrating substantial merit in using media to combat food insecurity
  • Showing that the client was uniquely positioned to advance this endeavor
  • Establishing that waiving the labor certification requirement would benefit the United States

Mr. Labreque highlights the unique aspects of NIW cases for artistic work: “Creative professionals have a strong path to NIW approval when their work advances issues of national importance. With the right strategy, they can show how artistic work drives public engagement, shapes national conversations, and contributes to the cultural and social landscape of the United States.”

The Approach

Defining the endeavor and demonstrating the three prongs of Dhanasar

Defining the National Interest Endeavor

We framed the client’s proposed endeavor as leveraging over two decades of expertise in film, advertising, and journalism to drive awareness and secure funding for reducing food insecurity across underserved communities and food deserts in the United States. The petition emphasized that hunger in America is a growing crisis, with one in six Americans going hungry, including the disabled, elderly, and more than 13 million children nationwide.

Demonstrating the Three Prongs of Dhanasar

Substantial Merit and National Importance: We aligned the client’s work with established national initiatives, including USAID’s and USDA’s Global Food Security Research Strategy, the Department of Health and Human Services’ “Healthy People 2030” initiative, and the USDA Food and Nutrition Service’s SNAP program. We highlighted compelling statistics about food insecurity and its far-reaching effects on mental health, physical development, academic achievement, and long-term economic impacts.

Well-Positioned to Advance the Endeavor: The petition showcased the client’s unique combination of academic credentials and 18 years of progressive professional experience. We included letters from peers and field experts supporting his continued work, evidence of his involvement in major film and documentary productions, and a detailed plan for future activities including securing funding, conducting interviews, and producing impactful documentaries.

Benefits of Waiving Labor Certification: We demonstrated that the United States would benefit from the client’s contributions without adversely affecting U.S. workers, as his specialized approach to addressing food insecurity through documentary production serves a unique national need that cannot be easily replicated through traditional employment channels.

The petition emphasized how the client’s work would empower people affected by food insecurity and engages local communities through targeted media campaigns. We highlighted his ongoing collaborations with non-profit organizations and his concrete plan to reduce food insecurity while expanding the reach of these organizations.

The Result

USCIS approved the NIW petition, demonstrating that artistic and creative professionals can qualify.

Current and Future Opportunities with NIW Approval
